POLICY OBJECTIVE:
This policy has been prepared based on the Regulation on the Deletion, Destruction, or Anonymization of Personal Data with the aim of defining our company's approach to managing the retention and destruction of personal data it collects and processes.
DEFINITIONS:
Destruction: Refers to the deletion, destruction, or anonymization of personal data.
Recording medium: Any medium where personal data is processed, either wholly or partially automatically, or through non-automatic means, provided it is part of any data recording system.
Periodic destruction: The deletion, destruction, or anonymization operation carried out at specified intervals in cases where all conditions for processing personal data, as listed in the law, no longer exist, as specified in the personal data retention and destruction policy.
Data recording system: A recording system where personal data is processed by structuring according to specific criteria.
REASONS AND PERIODS FOR RETENTION AND DESTRUCTION:
Our company securely retains personal data it processes in both physical and/or electronic environments, during the retention periods determined in the Personal Data Inventory and publicly announced in VERBIS (Data Controllers Registry), to fulfill its legally mandatory activities and commercial activities. In the Personal Data Inventory, it is defined where each personal data is processed, stored, and by which methods it is destroyed. Personal data is primarily preserved in compliance with the Protection of Personal Data Act No. 6698, Labour Law No. 4857, Occupational Health and Safety Law No. 6331, and all legislation conditions relevant to our company activities.
When determining personal data retention periods, the legal justification or processing purpose of the personal data is taken into account. If the personal data is collected and processed due to legal requirements, the retention period is defined as the period stipulated in the relevant legislation in the Personal Data Inventory. For other data, periods that allow for the performance of the related activities consistent with the purpose of processing are determined and defined in the Personal Data Inventory. While retention periods can sometimes be defined as “month” or “year”, for some personal data, they can be defined as “at the end of…”, “until… is done”. Therefore, different retention durations may be applicable for each personal data concerning the periods stipulated or necessary for the purposes they are processed.
Personal data is stored while taking “Data Security Measures” announced publicly in VERBIS. Administrative measures such as preparing an authority matrix for employees, providing training, entering confidentiality agreements with employees and data processors, are applied, alongside technical data security measures such as using updated antivirus systems, firewalls, backups, encryption, etc.
In the destruction of personal data, depending on the chosen method, the deletion, destruction, or anonymization process is conducted in a manner that makes it impossible to access, retrieve, use, or relate the data to the data subject again.
Personal data for which the retention period has expired is destroyed according to specified destruction methods and the operation is recorded using the Data Destruction Record. These records are kept for at least 3 years. In the retention and destruction of personal data, responsibilities determined by the “Personal Data Inventory” and “Authority Matrix and Authority Management Table for Personal Data” are assumed. Those involved in destruction processes are recorded in the Data Destruction Record.
Every three months (March, June, September, and December), our company reviews personal data, identifies data for which the retention period has expired, and in the first periodic destruction process following the emergence of the obligation to delete, destroy, or anonymize personal data, deletes, destroys, or anonymizes the data. This period does not exceed six months.
DESTRUCTION OF PERSONAL DATA UPON THE REQUEST OF THE DATA SUBJECT
Personal data subjects can request information about their data using the communication methods included in our General Clarifying Text on Personal Data. If this request is to delete the personal data:
a) If all conditions for personal data processing have ceased to exist, the personal data in question is destroyed upon request. The request of the data subject is finalized within 30 days at the latest and they are informed in writing or electronically.
b) If all conditions for personal data processing have ceased to exist and the data in question has been transferred to data processors, our company notifies the Data Processor and ensures destruction operations are conducted.
c) If not all conditions for personal data processing have ceased to exist, the request is rejected by our company with a reasoned explanation, and the refusal response is communicated in writing or electronically within 30 days at the latest.
